DELIVERY AND RETURNS
SHIPPING AND RATES
Goods will be shipped by Mada di Dario Romani using the carriers available
at the time. If the purchaser requests a specific carrier, Mada snc di Dario
Romani declines all liability after the goods have left its warehouses.
DELIVERY
Mada snc di Dario Romani & C determines the delivery times based on the
stock availability of the item in question. If it is in stock delivery is
estimated at 24/48 hours, subject to the availability of the carriers. If
instead the product is not in stock, the company requires a minimum of two
weeks and the times will be notified promptly in the relative order
confirmation.
CUSTOMS DUTY
Customs duty will be for the cost of the client in relation to each single
shipment, and the amount will be determined in accordance with the current laws
of the destination country, with notification of the client only at the time of
delivery. If the duty is not paid by the client, delivery will not be made, the
order will be cancelled and the amount of any customs duty that may have been paid
in advance by Mada snc di Dario Romani & C will be withheld from the price
paid by the client, subject to the right to request reimbursement of costs
sustained for shipment by Mada snc di Dario Romani & C.
INTEGRITY OF THE GOODS
At the time of delivery, the purchaser is required to check the integrity
of the packages and correspondence of the quantity and quality stated in the
consignment note. In the event of any difference the purchaser should accept
the goods with reservations and send a written notification to Mada snc di
Dario Romani & C within eight days of receipt. Any notification received
after the term indicated will not be taken into consideration.
RIGHT OF WITHDRAWAL
The purchaser may withdraw from the contact in writing without additional
charges or penalties and without the burden of justification, within 14 days of
receipt of the goods, by written notification sent by registered mail with
proof of receipt or by pec to the address madabags@pec.it. The
registered mail can be sent in advance by fax to 0861/611772. In this case return
of the goods will be subject to the following clause.
RETURN OF GOODS
Subject to the above, the client may request (within fourteen days of the
delivery date) Mada snc di Dario Romani & C to collect the goods delivered,
by fax or e-mail to info@madabags.it. The
request must indicate clearly the reason, the invoice or transport and delivery
documents. The request will be assessed by Mada snc di Dario Romani & C, and
the client will receive a reply as quickly as possible and in the case of
acceptance the goods will be taken back.
In any case the products must be returned complete, in perfect condition
and in their original packaging or at least placed in boxes and packaged well
to ensure safe transport. Shipping must be carriage paid. The returns must be
received no later than 30 days from acceptance by Mada snc di Dario Romani
& C. The client will nevertheless remain liable for any damage to the goods
of loss of value of the goods arising from improper handling or alteration of
the goods, or negligence or carelessness on the part of the carrier.
Warranties and Assistance
Procedures
1.1 Mada snc di Dario Romani & C is answerable for factory defects due
to manufacture, assembly and accessories considered as not conforming, which
emerge within one month of delivery of the goods.
1.2 For the purposes of this contract it is presumed that consumer goods conform
to the contract if, where pertinent, the following circumstances all coexist:
a) they are suitable for the use to which goods of the same type are usually
put; b) they conform to the description given by the vendor and possess the
qualities of the goods that the vendor presented to the consumer as a sample or
model; c) they have the usual quality and performance of goods of the same type,
that the consumer can reasonably expect, taking account of the nature of the
goods and, if the case applies, public declarations on the specific
characteristics of the goods made by the vendor, manufacturer or their agents
or representatives, particularly in advertising or on the labelling; d) they
are likewise suitable for the particular use desired by the consumer and the
vendor was made aware of such use at the time the contract was concluded and
that the vendor has accepted also for conclusive facts.
1.3 The client loses all rights if the vendor is not informed of any conformity
defect within one month of date on which the defect was discovered.
1.4 In the case of conformity defects, the client may alternatively request,
without charges and under the conditions indicated below, the repair or
replacement of the goods purchased, a price reduction of the goods purchased or
cancellation of this contract, unless the request is not objectively impossible
to grant or if it is excessively burdensome for Mada snc di Dario Romani &
C.
1.5 The request must be received in writing, sent by registered mail with proof
of receipt, by Mada snc di Dario Romani & C, which will indicate is
willingness to start processing the request, or present the reasons for which
this cannot be done, within seven working days of receipt. In the same
notification, where Mada snc di Dario Romani & C has accepted the client’s
request, the method of shipping or return of the goods must be indicated as
well as the term foreseen for the return or replacement of the defective goods.
1.6 If the repair or replacement is impossible or excessively burdensome, or if
Mada snc di Dario Romani & C has not repaired or replaced the goods within
the term mentioned in the previous point or lastly if the repair previously
done has caused considerable inconvenience, the client may decide to accept a
congruous reduction of the price or cancellation of the contract. In this case
the client must send his request to Mada snc di Dario Romani & C which will
indicate either its willingness to process such request or any reasons that
prevent such processing, within seven working days of receipt.
1.7 In the same notification, where Mada snc di Dario Romani & C has
accepted the client’s request, the client must indicate the price reduction
proposed or method of return of the defective goods. The reimbursement of the
sums previously paid to Mada snc di Dario Romani & C will be made either on
the Paypal platform for foreign clients or by bank transfer for clients in Italy.
REPAIRS
Firstly it should be pointed
out that all the articles produced under the Dario Romani trade name are
checked scrupulously and rigorously internally by the relative quality control
section before delivery to the client. That being said, Mada snc di Dario
Romani & C will carry out any repairs requested by clients and at no charge. The
company will also carry out repairs for factory defects that come under the
section on conformity defects in the previous paragraph. Shipping costs for
returns will be for the cost of Mada snc
di Dario Romani & C. No repairs will be done for
problems and defects due to incorrect use and wear of the product.
SHIPPING
MODE OF TRANSPORT:
Mada snc di Romani Dario & C snc is
organised to provide a rapid efficient delivery service.
Our shipments in Italy and abroad are handled by Brt and Gls Executive.
Mada snc di Romani Dario & C snc cannot reimburse the part of the
costs required by the transporter in the event of failure to deliver so we ask
our clients to provide a delivery address where someone will be present during
working hours.
For each delivery order the Client is required to provide a telephone number (preferably
mobile phone) so that the transporter can get in touch in the event of
difficulties in delivery.
If the delivery is not possible due to causes not attributable to Mada snc
di Romani Dario & C snc, or the express courier, after two consecutive attempts
at delivery, the cost of holding and redelivery as quantified by the express
courier will be debited, or it will be possible to collect the product at the
courier’s distribution centre.

DELIVERY TRACKING:
At the time of handing the goods over to the courier of your order you will
be sent a mail with a link to track the progress of your purchase.
The product will be delivered to the address indicated at the time the order is
confirmed.
INSURANCE OF THE SHIPMENT:
Mada snc di Romani Dario & C snc is not responsible
for shipping provided by third parties and if you require this shipping can be
requested and insured for the purchase value.
